1. Agreement to Terms

By accessing or using Aha ("the Service"), operated by Acalytica ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Aha is an AI-powered agency operating system that provides tools for campaign management, creative production, workflow automation, analytics, and multi-agent AI assistance. The Service utilizes third-party AI models (including Anthropic's Claude) to generate content, analysis, and recommendations.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Generate content that is harmful, abusive, discriminatory, or violates third-party rights
• Attempt to gain unauthorized access to other users' accounts or data
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to compete directly with Aha
• Exceed reasonable usage limits or abuse AI agent capabilities

5. AI-Generated Content

Content generated by AI agents within Aha is provided as-is. While we strive for accuracy and brand compliance, AI-generated content may contain errors, biases, or inaccuracies. You are responsible for reviewing and approving all AI-generated content before publication or distribution. We do not guarantee that AI-generated content will be free of intellectual property conflicts.

6. Your Content & Data

You retain ownership of all content, briefs, creative assets, brand guidelines, and other materials you upload to the Service ("Your Content"). By using the Service, you grant us a limited license to process, store, and display Your Content solely for the purpose of providing the Service to you.

We do not use Your Content to train AI models. Your brand guidelines, creative assets, and campaign data are isolated to your organization and are not shared with other users.

7. Subscription & Billing

Certain features require a paid subscription. Pricing, billing cycles, and plan details are available on our pricing page. You authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, Acalytica shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

10. Termination

We may suspend or terminate your account if you violate these terms. Upon termination, you may request an export of Your Content within 30 days. After 30 days, we may delete Your Content from our systems.

11. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated terms.
